Apple may have a serious problem on their hands if one angry Breaking Bad fan gets his way.
According to Deadline, one Dr. Noam Lazenbik alleged that he was "unfairly deceived, misled and taken advantage of by Apple's promise to deliver something it never intended to provide" and filed a class action complaint against Apple over Breaking Bad: Season 5 being split into two on iTunes.
This complaint began when Lazenbik and his son-in-law purchased a Season Pass for Season 5 of the AMC drama. As iTunes describes it, Lazenbik's understanding of the purchase was that "[t]his Season Pass includes all current and future episodes of Breaking Bad: Season 5."
In fact, "AMC had said that Season 5 of Breaking Bad would be split up but always insisted that the final cycle would consist of 16 episodes," Deadline notes. But when the second part of Season 5 began airing in August, Lazenbik found that his Season Pass was no longer valid. Instead, he learned that the rest of the episodes were bundled in another purchase called "The Final Season," which meant that he would have to "pony up another $22.99 or $14.99 in order to access it."
The Ohio doctor began by sending Apple a few emails, but to no avail -- hence the legal action. At the moment, Lazenbik is seeking damages of only $20, but if others join Spartacus here's movement, it could mean bad bongos for Apple, whose digital Breaking Bad episodes are among the most downloaded on iTunes.
